01 Marketplace Platform Status

Crucial Disclaimer

Now PT is a technology platform that facilitates connections. We are NOT an employer, an agent, or a fitness provider. Any booking creates a direct legal contract between the User and the Provider.

By using Now PT, you acknowledge that we act strictly as an intermediary. We do not employ, manage, or supervise the personal trainers or gym owners listed on our platform. The quality, safety, and legality of the services provided are the sole responsibility of the respective Provider.

02 Provider Responsibilities & Insurance

For Trainers

You must hold all necessary professional certifications and licenses. You represent that you maintain a valid Public Liability Insurance policy while active on the platform.

For Gym Owners

You must ensure your facility meets all local safety and health regulations and holds appropriate commercial property insurance.

03 Payments, Holds & Disputes

Now PT uses Stripe Connect for secure financial transactions. By using the platform, you agree to the following financial structure:

Platform Commission

Unless a different rate is shown at checkout or in your account, a 10% commission applies to the standard booking subtotal, collected as part of the payment flow before payout to the Provider. The Provider may have separate arrangements (for example, waived-commission clients). Any per-booking or processing fees are shown separately in the app.

Limited Payment Collection Agent

Each Provider hereby appoints Now PT as the Provider’s limited payment collection agent solely for the purpose of accepting the User's payment. You agree that payment made by a Client to Now PT shall be considered the same as payment made directly to the Provider.

The 48-Hour Dispute Window

To ensure service delivery and protect our community, all funds are held in a "Verification Period" for 48 hours following the scheduled end time of a session. During this window, Clients may "Report an Issue" through the platform. If an issue is reported, the payout is frozen until an Admin resolves the dispute.

Automatic Release

If no dispute is raised within 48 hours, the funds (minus platform commissions) will be automatically transferred to the Provider's Stripe account.

04 Service Standards & No-Shows

Provider No-Show

If a Provider fails to attend a session without prior cancellation, the Client is entitled to a 100% refund. The Provider may also be subject to platform penalties or account suspension.

Client No-Show

If a Client fails to attend a confirmed session, the Provider will receive the full payout (minus commission). No refunds will be issued for client no-shows.

05 Gym Space Rentals & Tripartite Liability

B2B & B2C Interactions

When a Personal Trainer rents gym space from a Gym Owner through Now PT and subsequently delivers sessions to Clients at that facility, three independent parties may be involved. Now PT remains a technology intermediary only and is not a party to the rental contract or the training contract.

Primary Insurance for Client Injuries

If a Client is injured during a session delivered by a Trainer at a Gym Owner’s facility booked through the platform, the Trainer’s Public Liability Insurance shall be the primary insurance for any injury, loss, or damage arising from the Trainer’s instruction, coaching, supervision, equipment use under the Trainer’s control, or failure to provide appropriate exercise guidance.

Facility & Structural Failures

The Gym Owner’s commercial property and public liability insurance shall be primary for injuries or losses arising from structural or premises failures (for example, ceiling collapse, defective building fixtures, unsafe common areas, or failures in building systems outside the Trainer’s control), subject to the Gym Owner’s policy terms.

Mutual Indemnity of the Platform

Each Trainer and each Gym Owner, when engaging in a space rental or session facilitated through Now PT, agrees to indemnify, defend, and hold harmless Now PT, its directors, officers, employees, and affiliates from any claim, demand, loss, or expense (including reasonable legal fees) arising out of or relating to their rental relationship, their delivery of services at the facility, or any injury occurring during a session at that facility, except to the extent finally determined to result from Now PT’s own gross negligence or wilful misconduct.

Property Damage by Trainers

The Trainer is 100% financially responsible for any property damage caused to a Gym Owner’s facility, equipment, fixtures, or contents during the rental period, including damage caused by the Trainer, their Clients, or anyone attending under the Trainer’s invitation. The Trainer must reimburse the Gym Owner promptly upon request and provide evidence of resolution if requested by Now PT.

Trainer No-Show (Gym Rental)

If a Trainer fails to attend a confirmed gym space booking without valid cancellation in accordance with the listing’s policy, the Gym Owner may retain the booking payment (minus applicable platform commission and payment processing fees), and the Trainer may be subject to account penalties or suspension.

Gym Rental Cancellation Windows

Each gym space listing displays its applicable cancellation policy before booking. Unless otherwise stated on the listing, policies include: full refund if cancelled at least 48 or 24 hours before the slot; 50% refund if cancelled within the stated window; or no refund where the listing is marked non-refundable. Cancellations outside the permitted window may result in forfeiture of the rental fee. The policy shown at checkout governs the transaction.

06 Non-Circumvention & Platform Integrity

No Offline Bypass

Users who connect through Now PT must complete all corresponding bookings and payments through the platform. Circumventing the platform to avoid commission or fees is a material breach of these Terms.

This includes, without limitation:

  • A Trainer and Gym Owner arranging space rental in cash or off-platform after being introduced via Now PT;
  • A Trainer and Client booking sessions directly after being introduced via Now PT;
  • Any attempt to solicit, redirect, or process payment outside the platform for services or rentals that originated on Now PT.

Penalties: A confirmed breach may result in immediate permanent account suspension for all parties involved. In addition, the breaching Provider agrees to pay Now PT a liquidated damages fee of €1,000 for each direct off-platform transaction with a user introduced via the platform, without prejudice to Now PT’s right to recover additional losses where permitted by law. You acknowledge this amount is a reasonable pre-estimate of harm to the marketplace and not a penalty.

07 Assumption of Risk & Health Waiver

Fitness activities involve inherent risks. By using Now PT, Users (Clients) acknowledge the following:

  • I am physically fit to participate in the activities I book.
  • I have disclosed all relevant medical conditions via the Par-Q form and understand how that health data is processed (see Section 08).
  • I voluntarily assume all risks of injury, aggravation of previous injuries, or loss.
  • I release Now PT, its directors, and employees from any liability arising from sessions booked through the platform, subject to Section 09.

08 Health Data & GDPR (Special Category Data)

Par-Q & Medical Information

Information you provide in the Physical Activity Readiness Questionnaire (Par-Q) and related health disclosures may constitute special category personal data under the EU General Data Protection Regulation (GDPR) and applicable Irish data protection law.

By submitting health information through Now PT, you explicitly consent to its processing for safety, eligibility, and session-delivery purposes. Full details are set out in our Privacy Policy, which forms part of your agreement with us.

  • Purpose: To assess readiness for physical activity, reduce injury risk, and allow assigned Providers to deliver sessions safely.
  • Access: Par-Q responses are visible only to the assigned Personal Trainer (and platform administrators where required for compliance or dispute resolution). Gym Owners do not receive your Par-Q or medical disclosures unless you separately choose to share them outside the platform.
  • Security: Health data is transmitted over encrypted connections (TLS) and stored on secured infrastructure with access controls limited to authorised personnel and systems on a need-to-know basis.
  • Retention & rights: You may withdraw consent, request access, rectification, or erasure subject to legal and safety exceptions, as described in the Privacy Policy.

09 Limitation of Liability

To the fullest extent permitted by applicable law, Now PT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost bookings, business interruption, or loss of goodwill, arising from use of or inability to use the platform (including outages, bugs, payment delays, or access-code failures), even if Now PT has been advised of the possibility of such damages.

Financial Liability Cap

In no event shall Now PT’s total aggregate liability to any user (whether Client, Trainer, or Gym Owner) for all claims arising out of or relating to these Terms or use of the platform exceed the total amount of commission fees actually paid by that user to Now PT in the twelve (12) months immediately preceding the event giving rise to liability, or €100 if no such fees were paid, whichever is greater. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence where such exclusion is prohibited).
